1. Purpose
This Acceptable Use Policy (“AUP”) governs the use of all services provided under the brand TheScanBadge, including:
- NFC badges
- QR-based digital profiles
- Digital business cards
- Pet identification tags
- Reservation systems
- APIs and integrations
- SaaS dashboard
This AUP forms part of the Terms of Service.
2. Lawful Use Only
Users may only use the Services for lawful purposes and in compliance with:
- Applicable EU and national laws
- GDPR and data protection laws
- Consumer protection regulations
- Intellectual property laws
The Services may not be used for illegal, fraudulent, or deceptive activities.
3. Prohibited Activities
The following activities are strictly prohibited:
3.1 Fraud & Misrepresentation
- Creating fake identities
- Impersonating individuals or organizations
- Publishing false credentials
- Using QR/NFC badges for scams
3.2 Phishing & Malware
- Linking to phishing websites
- Distributing malware
- Using NFC/QR for credential harvesting
- Redirecting users to harmful domains
3.3 Illegal Content
- Hate speech
- Terrorist content
- Illegal substances promotion
- Exploitation or abusive content
- Violations of export or sanctions laws
3.4 Medical & Emergency Misuse (Pet Tags)
Users must not:
- Publish knowingly false medical information
- Misrepresent veterinary conditions
- Use pet tags to simulate emergency services
- Claim medical endorsement by TheScanBadge
TheScanBadge does not verify medical data and reserves the right to remove misleading content.
3.5 Harassment & Harm
Users must not:
- Harass or intimidate others
- Publish personal data without consent
- Use badges for stalking or tracking
- Abuse reservation systems
3.6 Platform Abuse
Users must not:
- Attempt unauthorized access
- Circumvent security controls
- Reverse engineer the platform
- Overload APIs
- Use automated scraping tools
- Interfere with infrastructure
Rate limits apply to API usage.
4. Data Protection Obligations (B2B Customers)
Business customers acting as Controllers must:
- Ensure lawful basis for data processing
- Inform data subjects appropriately
- Not upload unlawful personal data
- Comply with GDPR obligations
TheScanBadge is not responsible for unlawful data uploaded by customers.
5. Intellectual Property
Users may not:
- Upload content infringing third-party rights
- Use TheScanBadge branding without permission
- Copy platform designs or software
- Resell services without authorization
6. Monitoring & Enforcement
TheScanBadge reserves the right to:
- Monitor platform activity for security purposes
- Investigate suspected violations
- Remove content
- Suspend or terminate accounts
- Limit API access
- Report illegal activity to authorities
Enforcement may occur without prior notice in cases of serious violations.
7. Reporting Violations
Suspected violations may be reported to:
Reports should include:
- Badge ID (if applicable)
- Description of violation
- Evidence (if available)
8. Consequences of Violation
Violation of this AUP may result in:
- Warning notice
- Temporary suspension
- Permanent account termination
- Blocking of NFC/QR functionality
- Legal action
TheScanBadge reserves the right to pursue damages where applicable.
9. Amendments
This AUP may be updated periodically. Continued use of the Services constitutes acceptance of revisions.
