1. Company Information
These Terms of Service (“Terms”) govern the use of the website, platform, NFC badges, QR services, APIs, digital profiles, reservation systems, and related services (collectively, the “Services”) provided under the brand TheScanBadge, operated by:

2. Scope & Acceptance
By accessing or using the Services, you agree to be bound by these Terms.
If you use the Services on behalf of a company, you represent that you have authority to bind that entity.
These Terms apply to both:
- Consumers (B2C)
- Business customers (B2B)
Where specific provisions apply only to consumers, this is explicitly stated.
3. Description of Services
TheScanBadge provides:
- Physical NFC badges
- QR-based digital identity services
- Digital business cards
- Smart pet identification tags
- Reservation management systems
- API integrations
- Apple Wallet / Google Wallet provisioning
- SaaS dashboard access
TheScanBadge does not:
- Provide legal identity verification
- Provide veterinary or medical advice
- Provide payment services (handled by third parties)
- Guarantee emergency services or response times
4. Accounts & Security
Users are responsible for:
- Providing accurate information
- Maintaining secure credentials
- Enabling 2FA where available
- All activity under their account
TheScanBadge may suspend accounts if security risks or violations are detected.
5. Acceptable Use
Users must not:
- Use Services for unlawful purposes
- Publish fraudulent or misleading information
- Engage in phishing or scam activities
- Create impersonation profiles
- Distribute malware
- Abuse API endpoints
- Publish unlawful or harmful content
- Provide false medical information
- Circumvent security measures
Violation may result in suspension or termination.
6. User Content Responsibility
Users remain solely responsible for content they publish, including:
- Contact details
- Business data
- Social media links
- Reservation data
- Pet medical information
TheScanBadge does not verify user-submitted content.
Users warrant that content:
- Is lawful
- Does not infringe third-party rights
- Is accurate to the best of their knowledge
7. Pet Tag Medical Disclaimer
TheScanBadge allows users to voluntarily publish pet-related medical information.
TheScanBadge:
- Does not verify medical information
- Is not a veterinarian
- Does not provide emergency services
- Does not guarantee real-time availability
- Is not liable for reliance on user-provided data
Pet owners remain fully responsible for accuracy and updates.
8. NFC & Physical Badge Disclaimer
Physical badges may:
- Be lost, stolen, cloned, or misused
- Be scanned by compatible devices
- Be accessed by third parties if publicly shared
TheScanBadge is not liable for:
- Unauthorized scanning
- Third-party misuse
- Physical damage
- Data accessed via publicly shared profiles
Users must deactivate lost badges immediately.
9. Orders & Payment
All prices are in EUR (€).
Payments are processed by third-party providers (e.g., Mollie). TheScanBadge does not store payment card details.
Orders become binding upon confirmation.
We reserve the right to refuse orders in case of fraud, pricing errors, or abuse.
10. Right of Withdrawal (Consumers Only)
This section applies exclusively to consumers within the EU.
10.1 General Rule
Under Articles 6:230m – 6:230s of the Dutch Civil Code, consumers have a 14-day right of withdrawal for distance contracts.
- For physical goods: 14 days from delivery.
- For digital services: 14 days from conclusion of the contract.
10.2 Exceptions (Article 6:230p BW)
The right of withdrawal does not apply to:
a) Personalized Goods
Goods manufactured according to the consumer’s specifications or clearly personalized.
This includes:
- Name-printed NFC badges
- Custom-designed badges
- Individually provisioned QR/NFC codes
- Custom corporate batches
Once production begins, withdrawal is not possible.
b) Digital Services After Activation
The right of withdrawal lapses where:
- The consumer has expressly requested immediate performance; and
- Acknowledged loss of withdrawal rights.
This applies to:
- SaaS activation
- Digital profile creation
- NFC provisioning
- Wallet pass generation
- Reservation system activation
10.3 Standard Goods
For non-personalized goods:
- Must be returned unused
- Consumer bears return costs
- Diminished value may be deducted if used beyond inspection
Refunds occur within 14 days of receipt.
11. Availability & SLA
Services are provided “as is”.
TheScanBadge:
- Does not guarantee uninterrupted availability
- May perform maintenance
- May modify features
- May apply API rate limits
Enterprise SLAs apply only if separately agreed in writing.
12. APIs & Third-Party Integrations
TheScanBadge may integrate with:
- Apple Wallet
- Google Wallet
- Google Maps
- Payment providers
We are not responsible for third-party services or policies.
API access may be limited or revoked in case of abuse.
13. Intellectual Property
All software, source code, branding, and materials remain property of TheScanBadge.
Users may not:
- Reverse engineer
- Copy
- Redistribute
- Resell
- Decompile
Except where mandatory law permits.
14. Data Protection
Personal data is processed in accordance with the Privacy Policy.
For B2B customers, a Data Processing Agreement may apply.
15. Limitation of Liability
To the maximum extent permitted by law:
TheScanBadge is not liable for:
- Indirect damages
- Loss of profit
- Loss of data
- Business interruption
- Reputational harm
Total liability is limited to the greater of:
- The total amount paid in the preceding 12 months, or
- €5,000
For consumers, statutory rights remain unaffected.
16. Indemnification
Users agree to indemnify TheScanBadge from claims arising from:
- User content
- Violation of these Terms
- Infringement of third-party rights
- Illegal or fraudulent use
17. Force Majeure
TheScanBadge is not liable for delays or failures due to events beyond reasonable control, including:
- Cyberattacks
- Infrastructure failure
- Internet disruption
- Government action
- Natural disasters
18. Suspension & Termination
We may suspend or terminate access if:
- Terms are violated
- Security risks arise
- Fraud is detected
- Payment obligations are unmet
Access ceases immediately upon termination.
19. Governing Law
These Terms are governed by Dutch law.
Disputes shall be submitted to the competent court in the Netherlands.
Consumers may rely on mandatory consumer protections of their country of residence.
20. Changes to Terms
We may update these Terms at any time.
The latest version will be published with a revised date.
Continued use constitutes acceptance.
